This application and website are our property, and our clients’ and partners’ property, and are protected by copyright, trademark, and other intellectual property laws. You may not use the application or website or the materials available in the application in a manner that infringes on our rights or that has not been authorized by us. You may not modify, reproduce, post, transmit, sell, or distribute any images from the application or website.

We work with businesses to provide consumers with the chance to obtain discounts. SavePass is not responsible for the quality of service or product provided by our business partners. We provide no promises or warranties regarding how our business partners

operate. SavePass is not responsible for any loss or damage incurred by consumers or businesses from any interactions between businesses and consumers. Additionally, each business may impose its own terms and conditions on the use and/or redemption of any discounts. Neither SavePass nor our business partners are responsible for how businesses handle such discounts, and whether businesses honor such discounts at all. We strive to provide notice of discounts to you through our application, as offered to us by such businesses; however, the actual handling of such discounts is between the consumer and the business. We are not responsible for businesses that change their discount programs, or for mistakes made by SavePass or our business partners in promoting such discounts.

To the fullest extent that law allows, neither SavePass, nor our affiliates are liable for any damages that result from the use or inability to use the application or website. We may collect and store information, including personally identifiable and non- identifiable information or other information, and we reserve the right to use such information to optimize our business. The information we collect may be collected directly by us, or it may be collected by a third party on our behalf.

Both consumers and businesses agree to indemnify and hold harmless us, our affiliates, and each of our respective directors, officers, managers, employees, shareholders, agents, representatives and licensors, from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees, that arise out of your use of the application or website. We reserve the right to take over the defense of any claim for which we are entitled to indemnification. You agree to provide us with such cooperation as is reasonably requested by us.

This agreement will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.
